Cualquiera que oiga el término MICKEY o vea la cabeza del célebre ratón, asocia estos dos con DISNEY, cualquiera, menos un paraguayo. Esto porque en Paraguay existe una marca registrada denominada MICKEY con el elemento figurativo de la cabeza del personaje. La marca protege la gama de productos desde la clase 29 a la 33, más el rubro de servicios de la clase 43.

La gran pregunta es ¿cómo pudo concederse un registro de marca cuya denominación y logotipo son tan inherentes a una empresa que nada tiene que ver con la solicitante? La respuesta se halla muy probablemente, en la legislación vigente en la época del primer registro de marca, que, por cierto, no pertenece a DISNEY.

A pesar de la inmensa dificultad para acceder a los documentos que hacen a estos casos, se intentará una aproximación a los mismos desde el estudio de las sentencias de la Corte Suprema de Justicia y del Tribunal de Cuentas.
