Jurisprudential developments on Patents, Industrial Models and Designs

Patents, utility models and industrial designs are protection tools directly related to the levels of innovation in a region. The number of patent applications and their licensing are generally signs of progress in the economy, incentives for innovation and growth in productivity. In today's world, the position of a judge or administrative entity in one country easily has an impact in another. We are not only united by TRIPS, subregional regulations, but also by the fact that we constantly share jurisprudence. The insurmountable barriers between common law and civil law no longer exist and a ruling by the United States Supreme Court can have as much impact in a Latin American country as a position by a European court.

Patents and the jurisprudence of the Court of Justice of the Andean Community

The Court of Justice of the Andean Community is the highest judicial body of that international organization, in charge of issuing mandatory preliminary interpretations about the common industrial property regime or Decision 486 for Colombia, Ecuador, Bolivia and Peru. Its positions are constantly cited by various courts and judges throughout Latin America.
