  The objective of this article is to determine the scope of piracy of audiovisual contents via streaming in the Americas. To do this, we will first analyze the terms related to the study topic: Streaming, Peer-to-Peer, Torrent, Cyberlocker, Cookies, Cracker, OTT, IPTV, VOD, SVOD, Password Sharing, ISP. Secondly, we will examine the legal framework and viable actions in the different jurisdictions, mentioning laws and/or international treaties that typify and/or could be applicable to the following piracy modalities via streaming, and ISP’s liability. Finally, we will have look at the guide of good forensic practices for the collection of evidence required to prove this type of infringement. Piratería de contenidos audivisuales vía streaming en las Américas

  El objetivo del presente trabajo es determinar el alcance de la piratería de contenidos audiovisuales vía streaming en las Américas. Para ello, en una primera etapa se investigará si en Argentina, Brasil, Canadá, Chile, Colombia, Ecuador, El Salvador, Estados Unidos, Guatemala, México, Nicaragua, Paraguay, Perú y Uruguay los términos Streaming, Peer-to-Peer, Torrent, Cyberlocker, Cookies, Cracker, OTT, IPTV, VOD, SVOD, Password Sharing e ISP han sido definidos por la ley, jurisprudencia o la doctrina. En una segunda etapa se revisará si la piratería vía streaming se encuentra tipificada como infracción en las jurisdicciones señaladas y si existen acciones legales para atacarla. En cada país se identificarán las leyes y/o tratados internacionales que les podrían resultar aplicables. En una tercera etapa se estudiará la posibilidad de exigir responsabilidades a los ISPs en los diversos países y se analizarán algunos fallos relevantes relacionados con las diversas modalidades de piratería vía streaming. Finalmente el lector encontrará una guía de buenas prácticas forenses para la recolección de pruebas tendientes a acreditar este tipo de infracciones en las diferentes jurisdicciones que fueron objeto de estudio.[:en]
