Comparative analysis of the protection of Geographical Indications and the risk of becoming considered as generic

  The protection of Geographical Indications and Appellations of Origin at the international level is regulated by means of international treaties, normally of a bilateral nature, which grant said protection within the framework of local legislation. In addition to this signing of treaties, WIPO administers the Lisbon Agreement for the protection of Appellations of Origin and their International Registration. Said Lisbon Agreement "contemplates the protection of appellations of origin, that is, the" geographical name of a country, a region, or a locality that serves to designate a product originating from the same and whose quality or characteristics must be exclusive or essentially to the geographical environment, including natural factors and human factors ""; however, it is only in force in 28 countries, which is a clear limitation for its effectiveness. Therefore, knowledge of local laws becomes essential in order to understand the scope of protection in each country and region of Geographical Indications and Denominations of Origin.

Análisis comparativo de la protección de Indicaciones Geográficas y el riesgo de llegar a considerarse como genéricas

  La protección de las Indicaciones Geográficas y Denominaciones de Origen en el ámbito internacional es regulada por medio de tratados internacionales, normalmente de carácter bilateral que conceden dicha protección en el marco de la legislación local. Además de ésta firma de tratados la OMPI administra el Arreglo de Lisboa relativo a la protección de las Denominaciones de Origen y su Registro Internacional. Dicho Arreglo de Lisboa “contempla la protección de las denominaciones de origen, o sea, la «denominación geográfica de un país, de una región, o de una localidad que sirva para designar un producto originario del mismo y cuya calidad o características se deben exclusiva o esencialmente al medio geográfico, comprendidos los factores naturales y los factores humanos»”; sin embargo, el mismo se halla vigente sólo en 28 países, lo cual es una clara limitante para su efectividad. Por lo anterior, se vuelve imprescindible el conocimiento de las legislaciones locales a fin de comprender el alcance de la protección en cada país y región de las indicaciones Geográficas y Denominaciones de Origen.
