LETTER OF COMMITMENT TO PROVIDE PRO BONO SERVICES

    2. GENERAL PRINCIPLES

    1. With the signature of this letter, the Associate becomes part of the “Pro Bono Associates” of ASIPI, which means that he makes himself available to the Association in order to render Pro Bono services in his country, in the areas of Intellectual Property detailed in the previous numeral.

    2. The General Principle is the goodwill of the Pro Bono Associate.

    3. In the event that ASIPI (through its Pro Bono Commission) requests ASIPI to take charge of a certain case, the Pro Bono Member shall communicate in writing, within 48 hours, whether he/she accepts or rejects such case.

    4. The consecutive rejection of three cases for which their services are requested, shall be cause for nomination for removal from the list of Pro Bono Associates. This suggestion shall be forwarded by the Pro Bono Commission to the Executive Committee.

    5. The Pro Bono Associate, once the case has been accepted, undertakes to use its best efforts to pursue and protect the rights of the Pro Bono Client.

    6. The Pro Bono Associate shall use its best efforts to ensure that the expenses associated with the case, to be covered by the Pro Bono Client, are reasonable.

    7. The Pro Bono Associate undertakes to be up to date with ASIPI's annuities, until the Pro Bono case(s) that has (have) been accepted is (are) completed.

    8. The Pro Bono Associate undertakes to sign all the documents required by ASIPI prior, during and after the corresponding Pro Bono counseling is rendered, among them, the Service Agreement, the Service Reports and the Termination Letter.

    9. In the event of using the trademark “ASIPI Pro Bono”, the Pro Bono Associate undertakes to do so in accordance with the terms and conditions set forth in the following paragraph.

    3. USE OF THE TRADEMARK “ASIPI PRO BONO”.

    1. “ASIPI Pro Bono“ is a mark (hereinafter ‘the Mark’) that guarantees that Pro Bono services are provided by active ASIPI members who have met all the requirements set forth in the ASIPI Pro Bono Program Regulations (”Pro Bono Associate").

    2. ASIPI shall provide the Pro Bono Associate with the correct logo to be used for such purposes, together with ASIPI's Trademark Use Manual, which duly and in detail indicates the permitted uses of the trademark.

    3. The Pro Bono Member may use the trademark in its various means of communication, whether digital or printed, in order to make known its collaboration with the ASIPI Pro Bono Program and at the same time disseminate the same. In any case, ASIPI may observe the Pro Bono Associate an incorrect use of the trademark and consequently require him/her (and he/she shall comply) to immediately cease such use.

    4. Upon termination of his/her functions as a Pro Bono Associate, for any reason whatsoever, the Pro Bono Associate shall cease to be authorized to use the mark and therefore shall immediately cease its use and/or any reference to it.
